The estimated delivery time is informative unless explicitly stated as a guaranteed delivery date.
In the event of unforeseen circumstances affecting delivery, SpongeCubs will notify the buyer accordingly whenever possible.
The buyer is responsible for the accuracy of the information provided for delivery. If delivery is not possible due to an incorrect or incomplete address, SpongeCubs may contact the buyer to correct the information.
8. Receipt of Shipment
Upon receipt, the buyer should check whether the packaging or shipment is visibly damaged.
If the shipment is visibly damaged, we recommend that the buyer record the damage with the delivery carrier and notify us as soon as possible.
Failure to provide such notice does not affect the consumer's statutory rights.
9. Right to Withdraw from the Contract
In distance contracts, consumers have the right to withdraw from the contract within 14 days without giving any reason, except in cases where the law provides an exception.
When purchasing goods, the withdrawal period generally starts on the day the consumer or a third party specified by the consumer (other than the carrier) acquires physical possession of the goods.
In the case of multiple items ordered that are delivered separately, the period begins on the day the consumer acquires physical possession of the last item.
The consumer must notify SpongeCubs of the withdrawal from the contract before the expiration of the 14-day period.
The buyer may exercise the right of withdrawal by submitting an unequivocal statement sent to: spongecubs@gmail.com.
10. Return of Goods
If the consumer withdraws from the contract, they must return or send back the goods without undue delay and no later than 14 days from the day they notified SpongeCubs of their decision to withdraw.
Goods should be sent to:
Fully fulfillment center
Letališka cesta 30, 1000 Ljubljana, Slovenia
The direct cost of returning the goods is borne by the consumer, unless agreed otherwise with SpongeCubs or required by law.
The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
11. Refund of Purchase Price
In the event of a valid withdrawal from the contract, SpongeCubs will reimburse payments received from the consumer no later than 14 days from receiving the notice of withdrawal.
SpongeCubs may withhold the refund until it has received the returned goods or until the consumer has provided proof of having sent back the goods, whichever occurs earlier, unless otherwise required by law.
Refunds are generally carried out using the same means of payment as the consumer used for the initial transaction, unless expressly agreed otherwise.
If the consumer chose a delivery method more expensive than the cheapest standard delivery offered, SpongeCubs is not required to reimburse the supplementary costs.
12. Exceptions to the Right of Withdrawal
The consumer does not have the right of withdrawal in cases specified by applicable legislation.
Among other things, the right of withdrawal may be excluded for goods that are unsuitable for return due to health protection or hygiene reasons, if they were unsealed after delivery or if protective seals were removed, provided statutory conditions are met.
If a statutory exception to the right of withdrawal applies to a specific product, the buyer will be informed accordingly prior to purchase.
13. Non-Conformity of Goods
SpongeCubs is liable for any non-conformity of goods in accordance with applicable law.
If the buyer believes the product is non-conforming with the contract, they can exercise their statutory rights.
The buyer should notify SpongeCubs of any discovered non-conformity as soon as possible at: spongecubs@gmail.com.
When processing a claim, SpongeCubs may request information from the buyer necessary to establish non-conformity, including the order number, description of the issue, and photographs of the product if necessary.
